These Terms of Service (“Terms”) govern your use of the Northwest 3D Homes website and services, including 3D walkthrough models and hosting (the “Services”). “Northwest 3D Homes,” “we” and “us” mean the business providing the Services. “You” means the person or company that orders a model, with or without an account, or creates an account. By checking the Terms box on the order form, placing an order or creating an account, you agree to these Terms.
1. Ownership of models and walkthroughs
Northwest 3D Homes owns all 3D models, model files, textures, source files, code and hosted walkthroughs it creates (“Models”), including all intellectual property rights in them, even when they are based on your plans. Payment for a model build pays for the creation of the walkthrough and your license below; it does not transfer ownership of the Model.
2. Your plans and drawings
You keep ownership of the plans, drawings, photos and other materials you provide (“Your Materials”). You grant Northwest 3D Homes a non-exclusive license to use, copy and modify Your Materials as needed to build, host, maintain and support your Models. You represent and warrant that you own Your Materials or have all rights and permissions needed to provide them to us for this purpose, and that doing so does not infringe anyone else’s rights, including an architect’s or designer’s copyright.
3. Your license to share the walkthrough
While hosting for a Model is active and your account is in good standing, you have a non-exclusive, non-transferable license to share, link to and display the hosted walkthrough link, for example on your website, listings, social media and with buyers, family or your builder. This license includes embedding the hosted walkthrough on your own website and in your listings (for example with an iframe embed code we provide), as long as the embed points to the walkthrough hosted by Northwest 3D Homes. Embedding is not a transfer of the Model and ends when hosting for that Model ends. You may not copy, download, extract, reverse engineer or re-host the Model or its files.
4. Hosting and buyouts
Models may be hosted only by Northwest 3D Homes; embedding or linking to the hosted walkthrough under Section 3 is not hosting elsewhere. If you want to host a Model elsewhere, you may purchase the Model (a “buyout”). The buyout price is quoted per model. After a buyout is paid in full, we will deliver the Model files and you may host and use them elsewhere, subject to any terms stated in the buyout quote.
5. Prices and billing
- Model builds: $250 per model, unless a different price is agreed in writing.
- Hosting: your first live model is hosted free while your account is in good standing. Each additional live model is $20 per month. Hosting fees are for hosting only and do not include a model build.
- Revisions: the first 3 revisions per model are free; each additional revision is $50.
We will invoice you for charges unless you pay at checkout. Prices may change for future orders and future billing months with notice; the price shown when you submit an order applies to that model build.
5a. Orders placed without an account
You can place an order as a guest. Guest orders are recorded under the email address you enter. You can set a password after checkout, or later create an account with the same email, and your orders will be linked to that account. Anyone who creates an account with that email can see those orders, so use an email address you control.
6. Non-payment
If an invoice is not paid when due, we may pause hosting for some or all of your Models until the balance is paid. Paused walkthrough links will not be viewable. We may remove Models that remain unpaid for an extended period after notice to you.
7. Revisions
A revision is a change you request to a completed Model, such as a layout, dimension or finish change. Request revisions from your account. Request revisions from your account. Each model includes 3 free revisions; additional revisions are $50 each. The request form shows whether a revision is free or charged, and you confirm this before submitting. Changes needed to correct our own errors against the plans you provided are not counted as revisions. Large changes, such as a substantially different plan, may be treated as a new model build.
8. Visualization only
Models are for visualization and marketing only. They are not construction documents, and they are not guaranteed to match the final construction, dimensions, materials, colors or finishes exactly. Colors on screens vary. Always rely on your approved plans, specifications and professionals for construction decisions.
9. Turnaround
Work on a model starts only after we review your plans and confirm your order with you. Turnaround depends on the size and complexity of the plan and on receiving complete files. Any estimate we give is not a guarantee.
10. Cancellation
You may cancel paid hosting at any time. Paid hosting continues through the end of the month you have paid for, and then ends; we do not give partial-month refunds. We may end free hosting of a first model after notice if the account is inactive or these Terms are breached. Model build fees are non-refundable once work has started. When hosting ends, walkthrough links stop working unless you have purchased a buyout.
11. Acceptable use
You agree not to use the Services for unlawful purposes, to upload material you do not have rights to, or to interfere with the security or operation of the Services.
12. Limitation of liability
The Services are provided “as is” without warranties of any kind, to the extent allowed by law. To the fullest extent permitted by law, Northwest 3D Homes is not liable for any indirect, incidental, special, consequential or lost-profit damages, or for decisions made based on a Model. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim.
13. Indemnity
You agree to indemnify Northwest 3D Homes against claims arising from Your Materials, including claims that they infringe someone else’s rights, and from your use of the Services in breach of these Terms.
14. Privacy
We collect the account details, files and order information you provide to deliver the Services and bill you. We do not sell your personal information. See our Privacy Policy.
15. Changes
We may update these Terms. If we make material changes, we will notify you by email or on the site. Continued use after changes take effect means you accept them.
16. Governing law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Washington, and you consent to their jurisdiction.
